What is Social Security Disability?

Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI) are the two most well-known Social Security disability benefits programs.

  • SSDI is only available to people who have worked and paid Social Security (FICA) taxes over the years through paycheck deductions. The more you have paid into the system, the higher your benefits, up to a maximum.
  • SSI is a need-based program also administered by the Social Security Administration. It is for people who have never worked or do not have enough work credits to receive SSDI. Eligibility depends on assets and other sources of income.

The definition of disability is the same for both programs, but the benefits are different. SSDI provides a monthly check based on your work credits. SSI provides a lower fixed benefit. People who qualify for SSDI or SSI can also qualify for Medicaid/Medicare.

SSDI and SSI

Receiving Social Security Disability benefits (SSDI or SSI) is a long and complex process. Most people are denied on the initial application and again on reconsideration. However, our Social Security Disability attorneys have had demonstrated success in hearings and appeals to win benefits for clients.

We handle SSDI and SSI cases on a contingency fee basis, requiring no out-of-pocket expense or hourly charges, and lawyer’s fees are federally regulated by the Social Security Administration. If your claim is approved, the legal expenses come out of the benefits payment.
