Who is eligible for Social Security Disability benefits?
You may qualify for Social Security Disability Insurance (SSDI) if you are unable to work for at least 12 months because of a qualifying physical or mental impairment. The Social Security Administration requires proof that you meet its definition of disability and that you cannot return to your job or perform any job on a sustained, full-time basis.
Under the right criteria, SSDI disability benefits and survivor benefits extend to:
- A disabled person who has paid into the system
- Dependent children up to age 22
- Adult children who are disabled
- Spouse or ex-spouse caring for children of the disabled person
- Widows/widowers over age 50 who are disabled
Our attorneys can help you determine if you qualify and if any family members qualify, including survivor benefits if the person who received SSDI has died.
What are the benefits under Social Security Disability?
Social Security Disability (SSDI) provides monthly income based on how much you paid into the system through payroll deductions. You can also qualify for full Medicare coverage after you have been eligible for SSDI for two years. Your spouse and children may receive dependent benefits up to a family maximum. When the disabled person dies, the children and the widow/widower are generally entitled to survivor benefits based on the deceased's Social Security record.
Our role is to help you and your loved ones get these benefits as soon as possible. We assist with initial claims, and we have a solid record in appeals of denied claims.
