Defective hip replacement attorneys

Zimmer Holdings, producer of more orthopedic devices than any other U.S. company, released the Zimmer Durom Cup as an artificial hip replacement implant in 2006. The Dr. Dorr report—defective device

Surgeons implanted the cup in over 12,000 patients nationwide, only to discover that a high percentage of the devices were failing or cups were loosening.

In April 2008, a prominent California orthopedic surgeon, Dr. Larry Dorr, reported to the American Association of Hip and Knee Surgeons (AAHKS) that out of 165 Durom Cup surgeries performed, 14 of his patients required revision surgery because of defective devices. While Zimmer had estimated a 5.7 percentage of failure, Dr. Dorr’s findings established a higher failure percentage rate. Dr. Dorr has been a successful orthopedic surgeon for more than 30 years.

Zimmer discontinued Durom cup sales and marketing efforts in May 2008 while claiming the device was not defective and that surgeons were not properly implanting the devices. Even if this were the case, Zimmer failed to provide adequate instructions and technical training so successful implantation could occur for every patient.

Lawsuits against Zimmer Holdings

Some patients who fully expected their Durom Cup implants to last the average 25 years of most hip replacements, required revision surgeries within two years after the implant. Many patients suffered pain and discomfort, along with a loss of income. Hip replacement surgeries are costly, with insurance companies paying an estimated $30,000 to $40, 000 per surgery.

Disgruntled surgeons whose practices were affected by Durom Cup failures, along with Zimmer Holdings shareholders, have filed lawsuits against Zimmer for failing to notify them sooner about Durom Cup issues.
